The term 'ACT Tuition' or 'us' or 'we' refers to the owner of the website. The term 'you' refers to the user or viewer of our website.

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

1. Webpages

1.1 Our notes are uploaded on an internal webpage. Your webpage will be pulled down following the closure of your course. Should you require the webpage to be re-uploaded, this is at a rate of EUR 25. Same re-upload is available for a period of 5 working days.

1.2 This website might use cookies to monitor browsing preferences. 

1.3 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

1.4 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

1.5 This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

2 For students / parents:

You have the right to withdraw from any tuition slots by sending us an email on [email protected] within 14 days of sending us an online or manual application form, without giving any reason whatsoever. Text messages, Facebook messages or simple phone calls will not be considered as withdrawals. After the period of 14 days expires no withdrawal will be possible and the following terms and conditions below will apply:

2.1 Moreover if you have selected to start tuition slots before the 14 day period, you are hereby acknowledging that you will lose your right of withdrawal for those lessons which would have already been given within this period. 

2.2 Cancellation or moving of the booked slots has to be made at least 48 hours (during the week) before the date of such lesson or lessons by sending an email on [email protected]. This is not applicable during weekends. Such slot will be moved to a mutually convenient date and time, within that same week or else, the week after. If however one is unexpectedly sick before a slot, a scanned medical certificate to [email protected] is required in order to move such lesson to another date or time. In case of one-to-one slots, these will be replaced with a slot on Skype. Text messages, Facebook messages or simple phone calls will not be considered as cancellations. Without the above procedure any unattended slots shall still be invoiced and be due or if already paid shall not be refunded. Note that extra slots requested by a student outside the normal set of slots, cannot be cancelled.

2.3 If one intends terminating the full slots, for whatever reason, one is to notify us 3 weeks in advance by sending us an email on [email protected]. Text messages, Facebook messages or simple phone calls will not be considered as termination requests. One is moreover bound to pay for any lessons within those three weeks from notification of termination, whether one attends for such slots or not. 

2.4 Any refund requested, will be bound to a 10% surcharge retained by ACT Tuition, covering administrative costs linked to initial registration and payment, together with the deduction of any bank fees incurred for bank transfer. In the case that students would have obtained notes as part of their full package, €75 will be retained to cover such notes.

2.5 In the eventuality that schools have to close, or in-person interaction not allowed, any service which was to be rendered, will be carried out online. 

2.6 Should a student fail to pay for the next set of lessons, by the last paid day of tuition, no lesson will be provided and student will be asked to return home, if lessons are given in person, unless a cancellation email has been sent at least 8 hours prior to the lesson and payment for such cancellation settled at the beginning of the lesson. 

2.7 In the eventuality that tuition is availing of any percentage off offer (such as the MATSEC, SEP, REV, OCT) offers run on a yearly basis, payment carried out is non-refundable. Clauses 2.1, 2.2, 2.3 are void. 2.3 in this case is only applicable for further sessions to be taken up. 

2.8 In the eventuality that tuition is availing of a per term payment or else the Online Academic Curriculum, payment carried out is non-refundable. Clauses 2.1, 2.2, 2.3 are void. 2.3 in this case is only applicable for further sessions to be taken up. 

2.9 For rescheduling of booked slots in the case of offers purchased, this has to be made at least 48 hours (during the week) before the date of such lesson or lessons by sending an email on [email protected]. This is not applicable during weekends. Such slot will be moved to a mutually convenient date and time, within that same week or else, the week after. Rescheduling of all slots for the full course will need a week's notice.

2.10 For online payment, should proof of payment not reach us before session agreed to, session will be dropped. Should you have paid and proof of payment not have reached us, we not replace the session. No refund is applicable.

2.11 Rates applicable to offers are only given for the period listed on the first invoice. Further terms or sessions booked at a later date, in case of no cancellation with be provided at a normal rate, unless specifically confirmed in writing.

2.12 In the eventuality that students are sick or unable to attend a session, as long as we are notified in advance, tutor will send all material via email.

3 In-Home Tuition

3.1 In the case of in-home tuition, should a student be younger than 18 years of age, a parent or guardian will need to be respeonsible and present in the premises at all times. Should tutors feel uncomfortable at any time, they should leav the premises immediately. Should the student / guardian feel uncomfortable with the tutor, they should are responsible to ask the tutor to leave immediately too. At no point of the lesson should tutor, student and/or guardian be smoking, using any drugs or medication or showing any disrespect, whether personal or cultural. Payments are to be solely carried out with ACT TUITION and any discussion of payments is prohibted with the tutors. Tutors are at no point allowed to ask for any payment from students and students are to disclose such to use immediately, if this occurs. Moreover, booking of further slots, is to be discussed with ACT TUITION.

3.2 Your use of this website and any dispute arising out of such use of the website is subject to the laws of Malta.

4. In the case of both in-home, online or in-premises tuition, we reserve the right change the tutor during the course. Continuation of syllabus is guaranteed.

5. Tuition booked and paid for is non-transferable to another student.
